Preamble

Welcome to askalf.com and thank you for your trust.

The Site is published by ALF SAS, a French société par actions simplifiée with a share capital of €8,606.50, having its registered office at 9 rue des Colonnes, 75002 Paris, France, registered with the Paris Trade and Companies Register under number 845 055 102, VAT identification number FR90845055102 (“Alf”).

The Site is hosted by AWS EU. The servers used are located in France.

These terms of use (the “Terms”) govern access to and use of the Site.

They do not govern subscription to the Alf platform, which is subject to separate subscription terms. The processing of your personal data and the use of cookies are described in a dedicated privacy policy.

By accessing or using the Site, you acknowledge that you have read the Terms applicable on the date of your last connection and that you agree to be bound by them. You undertake to comply with applicable laws and regulations.

If you do not accept the Terms, you must stop using the Site. We would nonetheless be glad to understand your decision: write to us at hello@askalf.com.

Definitions

“Site” means the website askalf.com, its directly accessible subdomains, and all of its pages and content.

“Content” means the items published on the Site: text, images, graphics, illustrations, logos, trademarks, photographs, videos, sound, documents and databases.

“User”, “you” and “your” mean any person who accesses or uses the Site. If you access the Site on behalf of a company, organisation or other entity, “you” also means that entity. You then represent that you are its authorised representative and that you have the power to bind it.

“Alf”, “we”, “our” and “us” mean the company ALF SAS.

Article 1. Purpose

The Site presents Alf and its platform. It provides general information: presentation pages, blog, videos, frequently asked questions. It allows you to contact us and to request a demonstration.

The Site does not, by itself, give access to the Alf platform. Such access requires a subscription, governed by the subscription terms.

Article 2. Scope

The Site is intended for individuals of full age and legal capacity, and for legal entities represented by a duly authorised representative.

By using the Site, you acknowledge that you are acting for purposes that fall within the scope of your commercial, industrial, craft or professional activity. You are therefore not a consumer within the meaning of consumer law.

If you are subject to laws other than French law, the Site is offered to you at your own risk. You are solely responsible for ensuring that your use complies with the laws and regulations applicable to you.

Article 3. Access to the Site

Access to the Site is open and free of charge. Connection and equipment costs remain your responsibility.

We endeavour to keep the Site accessible at all times. We do not guarantee continuous availability or the absence of interruption.

Access may be suspended at any time, in particular for maintenance, updates or security reasons.

Article 4. Hosting and security

We implement reasonable and available measures to preserve the security and integrity of the Site and of our exchanges with you.

The Site is hosted on AWS EU infrastructure. The servers used are located in France. Our host uses standard encryption technologies, in particular the TLS protocol.

No service is tamper-proof. Our host nonetheless maintains the ISO/IEC 27001, ISO/IEC 27017, ISO/IEC 27018, ISO/IEC 27701 and PCI DSS Level 1 certifications, as well as the SOC 1, SOC 2 and SOC 3 attestation reports. It has several years of experience in managing and securing large-scale data centres.

Article 5. Right to use the Site

We grant you a personal, non-exclusive and non-transferable licence, revocable at any time, to access the Site and consult its Content.

This licence is limited to consulting the Site. It allows you to display its pages and, for your sole use, to print or save a single copy, provided that you keep all proprietary notices.

It confers no other right on you. Any other use requires our prior written consent.

Article 6. Intellectual property

The Site and its Content are the exclusive property of Alf or of its licensors. They are protected in particular by copyright, trademark law and database law.

The following are prohibited without our prior written consent: the reproduction, representation, adaptation, translation, modification, extraction and re-use of all or part of the Site or of its Content, as well as any disassembly, decompilation or decryption.

Our trademarks, logos and domain names may not be used without our written authorisation.

Article 7. Prohibited uses

You undertake not to, directly or indirectly:

(i) copy, distribute or disclose all or part of the Site, on any medium, including by automated data extraction (“scraping”);

(ii) engage in any conduct likely to interrupt, suspend, slow down or prevent the operation of the Site;

(iii) impose a disproportionate burden on its infrastructure;

(iv) use any automated system sending our servers more requests than a human being could produce over the same period. Public search engine operators are authorised to index the Site for online search purposes, without caching or archiving data; this authorisation is revocable;

(v) send spam, chain messages or any other unsolicited email;

(vi) access, or attempt to access, the Site’s systems without authorisation, or compromise their integrity or security, in particular by uploading invalid data, viruses, worms or any other malicious software;

(vii) collect or extract personal data from the Site;

(viii) use the Site for commercial solicitation purposes or contrary to its purpose;

(ix) copy, modify, translate, reproduce or extract the Content, misappropriate it or derive a work from it;

(x) access the Content by any technology or means other than those we provide or authorise;

(xi) circumvent the security measures restricting access to the Site or to its Content.

Article 8. Suspension of access

In the event of a breach of the Terms, we may suspend or prohibit your access to the Site, without notice and without compensation.

Article 9. User’s liability

You use the Site in good faith.

In the event of a breach of the Terms, you shall indemnify us against any third-party claim, action or demand. You undertake to make good the loss suffered and to bear the resulting costs, expenses and awards.

We are not liable for any malfunction of the Site resulting from your own use.

Article 10. Alf’s liability

Alf exercises the care and diligence necessary to make the Site and its Content available. In this respect, Alf is bound by an obligation of means only.

The Site and its Content are made available for general information purposes. The Content may contain inaccuracies or may no longer be up to date.

We are not liable for:

(i) your use of the Site;

(ii) any unavailability, interruption or slowdown of the Site;

(iii) any malfunction attributable to a third party or to an event beyond our control;

(iv) any indirect damage, in particular any loss of revenue or of opportunity;

(v) any virus or malicious program transmitted by a third party through the Site;

(vi) the content of third-party sites accessible from the Site.

Article 11. Hyperlinks

The Site may link to third-party sites. These sites are not under our control. We are not responsible for their content, their availability or the processing they carry out.

Creating a link to the Site requires our prior written consent, except for a simple citation link to the home page.

Article 12. Technical service providers

The operation of the Site relies on technical service providers, in particular for hosting, audience measurement and messaging.

If you refuse the use of these providers, you cannot access the Site.

The processing of personal data carried out by these providers is described in our privacy policy.

Article 13. Changes to the Site and to the Terms

We freely decide on the Content and the features of the Site. We may add to them, modify them or remove them at any time, without notice and without compensation. You may not claim that they are exhaustive, nor that they will be maintained or replaced.

We may amend the Terms at any time. The applicable version is the one published on the Site on the date of your connection. We invite you to consult it regularly.

Article 14. No legal advice

Alf is not a law firm and does not provide legal advice, in accordance with the French Act of 31 December 1971, as amended.

Use of the Site creates no attorney-client relationship, nor any other special relationship between you and Alf, its employees, its officers or its affiliates.

The Content of the Site constitutes general information. It does not amount to legal advice and does not replace the opinion of a professional competent in respect of your situation.

Article 15. Personal data and cookies

The processing of personal data carried out in connection with your use of the Site, and the use of cookies, are described in our privacy policy, available at https://askalf.com/privacy-policy/.

Article 16. Language

The Site and its Content are provided in French and in any other language chosen by Alf, as a free and informative translation. Alf does not warrant the translations.

In the event of any discrepancy between versions, the French version of the Terms prevails.

Article 17. Notices

We may send you notices by email, SMS, postal mail or by posting on the Site.

We recommend that you add the address hello@askalf.com to your list of approved addresses. We are not responsible for the consequences of any automatic filtering of your emails.

Article 18. Miscellaneous

The Terms constitute the entire agreement between you and Alf in respect of the use of the Site.

The invalidity of one clause does not entail the invalidity of the others.

Failure to enforce a right or a clause of the Terms does not constitute a waiver of that right or clause.

Article 19. Governing law and jurisdiction

The Terms are governed by French law.

In the event of a dispute, you undertake to seek an amicable solution. Failing that, the dispute shall be brought before the courts of Paris, unless otherwise provided by law.
